Because it's not a hearing, it's an oral argument scheduled at the request
of the New York State Office of Renewable Energy Siting. Instead of
presenting new evidence and testimony, this is a much more limited
proceeding requested by ORES to further develop the record against an
appeal by the Grassland Bird Trust concerning its denied petition for party
status in this matter. It's going to be an argument between lawyers in
front of the administrative law judges on a very specific issue, not an
open venue for general public comments on the entire matter, which is why
the notice specifically invites non-party attendees to "*observe*" the oral
argument. I have no doubt that all non-party attendees will be
automatically muted for the entire Webex call.
